Terms and Conditions of Sale

These terms and conditions govern the sales of products (referred herein as "Product"), any order placed with ANIX VALVE USA (referred herein as "Seller") and products delivered to customer ((referred herein as "Buyer").

Payment

Payment term is net cash unless credit term approved. Payment can be made by check, ACH or credit card for domestic orders within the United States with a convenience fee of 3% for credit card payment. All customers outside of the United States must wire transfer payment to Seller's bank account before shipment or upon confirmation of order. 

40% down payment is required to be paid upon confirmation of order for made to order products, custom made products, designated sourced products, emergency responded products, private label products or OEM products. 

Shipping & Delivery

All Domestic orders with in-stock items will be processed and shipped within 1-3 business days after receipt of order. All orders will be shipped via UPS Ground, USPS, FedEx, DHL, motor freight or ocean freight at the expense and discretion of buyer. Delivery time valid at time of quote and may change at time of order. All sales are either “Ex Works” or FOB point of shipment and buyer outside of United States are responsible for the freight and duty.    

Prices & Quotations

Prices are subject to change without notice. All prices quoted are either “Ex Works” or FOB point of shipment and valid for 14 days from the date of the quotation. Payment term is net cash unless credit term approved. Delivery time valid at time of quote and may change at time of order. It is the BUYER responsibility to verify that our quotation meets the technical and commercial requirements of the inquiry and service applications. 

Return Policy

This return policy is only applicable to off-the-shelf Standard materials, parts or products under ANIX brand label. Under no circumstances may any Products be returned that are used, damaged, made to order, custom made product, designated sourced product, emergency responded product, modified or product items marked "non-cancellable" or "non-returnable" or manufactured for OEM or private label. RMA number will be issued to buyer, if Seller agree to the return. Credit Memo for the accepted unused Products will be issued to Buyer after inspection.

All return arrangements and shipping cost are the responsibility of the buyer. All products to be returned must be properly packaged, must be sent back complete and unused or have not been installed and are in resalable condition.

There will be restocking fee for wrong product ordered returns or any other reasons of return. Products returned within the first 30 days from date of purchase are subject to a minimum restocking fee of 25% of the invoice amount. Products returned 30-60 days from date of purchase are subject to a minimum restocking fee of 30% of the invoice amount. No returns will be accepted after 60 days from date of purchase except under the terms and conditions of the warranty. Seller reserves the right to charge a minimum 40% restocking charge or deny a credit for damaged or used products.

Accounts with average returns higher than industry standard may be subject to an additional restocking fee. This will be assessed on an individual basis.

Returns will be accepted for exchange or replacement of defective materials subject to the term and conditions of the warranty. Seller will also accept return for products wrongly shipped by mistake without restocking fee.    

Limited Warranty

All products are sold new and is warranted to be free from defects in material and workmanship. Any piece found to be defective under normal use and service without any modification of the original products may be repaired or replaced with parts or components within 12-18 months from the date of purchase. Return and Shipping cost will be paid by the buyer. Repairs on products to be free from defects in workmanship or material for 6 months from delivery (but only as to the material or component repaired by Seller), or the remaining initial warranty period, whichever expires later. 

Custom made products or manufactured for OEM or private label are not warranted under the above terms and conditions. Such products will be under separate warranty.    

Products furnished by Seller but not manufactured by Seller will carry only the warranty of the manufacturer of the product, if any. Seller does not warrant any product not manufactured by Seller.

Limitation of Liability

In no event shall Seller be liable to Buyer or third party for any special, incidental or consequential damages; any loss of use, revenue or profit, whether similar or dissimilar, of any nature arising or resulting from the purchase, shipment delay, installation, removal, repair, operation, use or breakdown of the product(s) or any other cause whatsoever, including negligence.
